Prenuptial Agreement

A prenuptial agreement is an agreement which marrying couples can enter into to settle the handling of their properties obtained both before and during their marriage.

Prenuptial agreements also can help you to make a financial planning during your marriage, including which property is considered to be marital property or personal property. With this agreement, you can agree not to have the marital property during the marriage or agree regarding the marital property division in the event of a divorce, which will help you to divide the property fairly and equitably and will help reduce any arguments in the unfortunate case your couple will face a divorce. 

Once both parties agree to enter into the agreement and the agreement is registered together with the marriage at the local district office, this agreement will fully bind both parties. Under Thai Law, this agreement may only be amended by the Court’s judgment, which means that this agreement will encompass and protect the rights according to your intentions at the time of the marriage registration.

The prenuptial agreement might be well-known in other countries such as the United States of America, the United Kingdom, Australia, or others countries, but Thai people might not be familiar with this kind of agreement or the concept of such agreements.
