Thailand has recently passed the draft legislation for the Civil Partnership Act B.E. …. and the Amendment to the Civil and Commercial Code (No. ..) B.E. …., which aims to provide legal recognition and protection for same-sex couples. The key points of this groundbreaking legislation are as follows:

  • Allowing same-sex couples to register their civil partnership under the law, granting them rights and duties similar to married couples, such as cohabitation, property management, adoption, and inheritance.

  • Civil partnership registration is permitted when both partners are Thai nationals, or at least one partner holds Thai citizenship.

  • Establishing rules for registration, dissolution of civil partnerships, and other cases, such as nullity and termination of civil partnerships.

  • Amending the Civil and Commercial Code to align with the new law, such as prohibiting marriage/partnership duplicity, adding grounds for divorce, and reasons for terminating alimony payments.

  • Aiming to recognize and protect the rights of same-sex couples in line with gender diversity in today’s society, following the principles of human rights.

  • The legislation must pass through the House of Representatives and the Senate, with comprehensive public hearings from all stakeholders to ensure fairness and practicality for the benefit of the nation and its people.
